Terms and conditions
Contracts can be concluded in German or English. For contracts concluded in English, this English version applies (German version).
1. Scope and provider
These terms apply to all contracts about alpin.studio between you and jakoby.design, owner Jakob Winterholler, Ringstraße 2, 82362 Weilheim, Germany, email hallo@alpin.studio ("we"). Other terms only apply if we expressly agree to them.
2. What you get
alpin.studio provides digital content for preparing mountain tours: routes in sections, walking times, packing lists, turnaround points, getting there, weather rules and a 3D view. The content is shown in the browser on alpin.studio; downloads are not part of the service.
To use it you need an internet connection and an up-to-date browser, for example Chrome, Safari, Firefox or Edge. The 3D view also needs WebGL, which current browsers support on most computers, tablets and phones.
The content is a planning aid. It does not replace your own checks on site, current weather and avalanche reports, map and trail markings or a mountain guide, and it is not a navigation device. You decide yourself whether a tour is right for you. Please read the risk notice.
We maintain the content and update it when sources change. Updates needed for the content to remain in conformity are provided during the term of the contract (§ 327f BGB).
3. Conclusion of contract
The mountains shown on the website are not yet a binding offer. "Buy this mountain" takes you to the order summary. There you see product, final price and payment methods, can redeem a discount code, enter your email address, accept these terms and give your separate consent to the immediate start (see section 7). Until then you can check and change all entries or simply leave the page.
By clicking "Order with obligation to pay" you make a binding offer, stating your email address. You are then taken to the payment page of our payment provider Stripe, where you choose the payment method, enter your payment details, check them before paying and complete the payment. The contract is concluded when the payment is confirmed and we send you the contract confirmation with your access link by email. If you do not complete the payment, no contract is concluded and nothing is charged.
Contract languages are German and English; the version in the language in which you ordered applies. We store your order data. You cannot retrieve the contract text for your order online after the purchase; you receive it in full, i.e. these terms and the withdrawal policy, with the confirmation email. The current terms are also available at alpin.studio/en/terms/.
4. Prices
Single mountain: €14.90 one-time, no subscription. Access has no time limit and applies as long as alpin.studio is operated.
All prices are final prices. As a small business under § 19 UStG we do not charge VAT.
5. Payment
You can pay by credit or debit card, Apple Pay, Google Pay or Klarna. Which of them you see depends on your device and browser (Apple Pay, for example, only on Apple devices). Payment is handled by our payment provider Stripe. The price is due immediately. You receive the invoice by email after the purchase; it is created via Stripe on our behalf.
6. Discount codes
You enter discount codes, for example from partners, on the order summary, where you see the reduced final price before ordering. One code applies per purchase. A code is only valid in the stated period, is not paid out in cash and cannot be applied after the purchase.
7. Right of withdrawal
As a consumer you generally have a right of withdrawal; details are in the withdrawal policy. For digital content it expires when we begin providing it after you have expressly agreed that we start before the withdrawal period ends, confirmed that you thereby lose your right of withdrawal, and we have confirmed the contract to you.
8. Usage rights
You receive a simple, non-transferable right to use the content for your own tour planning. You may not pass on access links or access. Systematic copying, reselling or automated extraction of the content is not permitted. Third-party terrain, aerial and map data are subject to the licences named in the imprint.
Test codes: We give free test codes to selected testers. Only they may use them; they give no right to permanent access and can be blocked at any time.
9. Defects
The statutory rights for defects of digital products apply (§§ 327 ff. BGB). Please report errors to hallo@alpin.studio.
10. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and under any guarantee given. For slightly negligent breach of an essential contractual obligation, i.e. one whose fulfilment makes the contract possible in the first place and on which you may rely, we are only liable for the foreseeable damage typical for the contract. Otherwise liability for slight negligence is excluded.
Mountaineering and hiking in high mountains are dangerous. You decide yourself and at your own responsibility whether to start, continue or abort a tour.
11. Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
12. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection rules of the country of your habitual residence remain unaffected. If individual provisions are invalid, the rest of the contract remains valid.
